Permitting & Compliance - Registered Petroleum Storage Tanks

At the Kennedy Space Center, NASA and its resident contractors own and operate both underground storage tank (UST) and aboveground storage tank (AST) systems. Design, construction, and maintenance requirements for USTs are governed by federal requirements found in Title 40 Code of Federal Regulations (CFR) 280. However, there are currently no Federal regulations covering aboveground storage tanks, except that 40 CFR 112 requires Spill Prevention, Control and Countermeasure (SPCC) plans for all oil storage tank facilities. In Florida, regulation of petroleum storage systems are identified in the Florida Administrative Code (FAC) Chapters 62-761 and 62-762. The Florida Department of Environmental Protection (FDEP) has contracted with Brevard County Office of Natural Resources Management (BCNRMO) to administer the storage tank program in Brevard County. BCNRMO representatives oversee all registered petroleum storage tank activities at KSC including: installations, registration, repair, closure, and inspections.

No special contractor license is required to install, remove, or perform maintenance work on aboveground tank systems; however, all documentation and records of work should be maintained by the operator on-site. Underground storage tank system installation, repairs, and/or removal must be completed by a Florida-certified Pollutant Storage System Specialty Contractor (PSSSC).

Each operator of a registered petroleum storage tank on KSC property is required to maintain certain monthly and annual records for a period of 2 years (3 years for SPCC tank locations). These records include inspection reports, tests of all monitoring or release detection systems, and all maintenance and repair information. These records must be made available for inspection by NASA (or designated contractor), FDEP or, BCNRMO inspectors.
